Mr. Pollock claims that he was on his way to the bathroom when tripped and fell out of the window down 25 feet to the ground. The Cahill‚Äôs claim they did not see the window as a risk to Mr. Pollock which was why they did not warn him in any way about the danger of it being opened. They are saddened at what happened but deny they are at fault.
The Judge is waiting until a later date to make a final decision on the case.
