[vc_row][vc_column][vc_column_text]Mark Pollock is a man that has achieved so much in his life after he lost his vision at the young age of 22. He was the first blind man to race to the South Pole and has completed multiple Ironman competitions, marathons, and even a 1,400 mile Round Ireland Yacht Race. Pollock has won bronze and silver medals at the Commonwealth Games in the early 2000’s.
Mr. Pollock tragically fell out of a window one evening at his friend’s house. Apparently, there was a window that was left opened in the room he was sharing with another person. It was a hot evening and it was very common for windows to be left opened to cool off the rooms. Mr. Pollock was not informed that there was a window or that the window would be opened. The owners, Enda and Madeline Cahill, neglected to warn him and are now being blamed for his catastrophic injuries including his spinal injury.
Mr. Pollock claims that he was on his way to the bathroom when tripped and fell out of the window down 25 feet to the ground. The horrific accident caused major spinal injuries paralyzing him for the rest of his life. He now requires constant care and is suing his good friends for millions. Mr. Pollock does not want his friends to come out of pocket for any expenses. He wants their homeowner’s insurance policy to be the party that pays for his care.
The Cahill’s legal team argues that they had no way of foreseeing the accident and that all charges be dismissed. They do not see how they are at fault in any way even though, when asked, they told the courts that they would not have left a child alone in the room with the window opened. The Cahill‚Äôs claim they did not see the window as a risk to Mr. Pollock which was why they did not warn him in any way about the danger of it being opened. They are saddened at what happened but deny they are at fault.
The Judge is waiting until a later date to make a final decision on the case.
